Summary of Case
"A social media freelancer, Pir Muhammad Kakar won the defamation case in district and Session Judge Court, Loralai in June 2023 following his arrest in July 2022. Kakar is not affiliated with any organization these days however he was arrested by the Loralai police station last year in July 2022. Speaking to PPF, Pir Muhammad Kakar said last year in July he was arrested by the Loralai police officials on the criminal complaint registered by the then Deputy Commissioner Ateeq-Ur-Rehman accused Pir for defaming him by posting news stories on his social media account and sent Pir the defamatory notice on behalf of his driver Dur Muhammad, after which he got arrested by the police officials in July and then he was later released after one week of detention Kakar was released on the interim bail and then proceeded his case into the Balochistan High Court where the defamatory notice was dismissed. Additionally he said, in June 2023 in Loralai district session Judge court Justice dismissed the defamatory notice of the driver and DC as he sent the defamatory notice to Kakar, after which on July 3, 2023 Kakar sent another defamation notice to the driver and summoned him into the court by July 15, 2023 or else submit the apology letter to him. “Right now me and my legal team are waiting for DC or his driver to apologize or present themselves in the court,” Kakar added. Amirullah, son of Pir Muhammad Kakar told PPF that his father has won the case in Balochistan High Court which he was fighting in the court against the Deputy Commissioner Ateeq-ur-Rehman in June 2023. Additionally he said, his father has sent the counter defamatory notice to the driver of DC Rehman as he was the complainant in the defamatory notice and summoned him in the Court within 10 days. “My father was arrested due to his journalistic work and the abduction was a direct attack on freedom of expression” Kakar added. Present Deputy Commissioner Subhan Dashti told PPF that Pir was arrested due to his personal enmity with the former Deputy Commissioner Rehman and due to their personal fight between Kakar and Rehman, Rehman sent the defamatory notice to Kakar. Former President of Balochistan union of Journalists, Salman Ashraf told PPF that the case of Kakar and DC is unrelated to journalism because Kakar was arrested by the Loralai police over the charges of violating the laws by beating the driver of DC and Kakkar was not arrested over the defamation notice however he was arrested due to the criminal complaint registered by the driver of the then DC Ateeq-ur-Rehman. "
